Terms

  1. Rental period. The rental starts on the delivery date. Each day the container stays past the rental period is billed at the extra-day rate above until the Company picks it up.
  2. Weight. The rental price includes the weight shown above. Weight over that amount is billed at the overage rate, measured by the disposal facility's scale ticket.
  3. Loading. Material may not be loaded above the top of the container walls, and the container's doors must close. The Company may refuse to haul an overloaded container until the excess is removed, and may bill a trip charge.
  4. Prohibited items. The Customer will not load hazardous waste, liquids, paint, oil, solvents, batteries, tires, propane tanks, appliances containing refrigerant, or other items the disposal facility refuses: ______. Prohibited items found in a load are billed at $______ each or at the facility's charge.
  5. Placement and surface damage. The Customer chooses the placement spot and is responsible for any damage to driveways, curbs, lawns, or other surfaces from placing, loading, or removing the container. Boards under the container are available on request.
  6. Access. The Customer will keep a clear path for the truck on delivery, swap, and pickup days. If the truck cannot reach the container, or it cannot be loaded safely, the visit may be billed as a trip charge.
  7. Permits. The Customer is responsible for any permit needed to place the container on a street or public property, unless the Company agrees in writing to obtain it.
  8. Payment. Charges are due ______ days after the invoice date. The deposit, if any, is applied to the final invoice. Past-due balances may carry a late fee of ______.
  9. Damage and loss. The Customer is responsible for damage to the container beyond normal wear, including fire, while it is in the Customer's care.
  10. Entire agreement. This agreement and any attached quote are the whole agreement between the parties. Changes must be in writing and signed by both. This agreement is governed by the laws of the State of ______.

Three things that make it hold up.

  1. List the prohibited items your landfill or transfer station actually refuses. That list differs by facility, and it's the one the customer will be charged against.
  2. State the included tons and the overage rate in numbers. Most roll-off disputes are about weight, and the scale ticket is the evidence.
  3. Take a photo of the placement spot at delivery. The surface damage clause is easier to stand behind with a before picture.
