Terms

  1. Rental term. The rental begins on the delivery date and continues until the Company picks up the units. Either party may end an open-ended rental with ______ days' notice. Charges run until pickup.
  2. Service. The Company will service each unit on the schedule above: pumping, cleaning, and restocking paper and supplies the Company provides. Extra service requested by the Customer is billed at $______ per unit per visit.
  3. Rates and billing. The Customer will pay the rates above every ______ (28 days / month / other) in advance / in arrears (circle one). Invoices are due ______ days after the invoice date. Balances past due more than ______ days may carry a late fee of ______ and may lead to the units being removed.
  4. Placement and access. The Customer will choose a level, safe spot reachable by a service truck within ______ feet, and keep it clear on service days. If the truck cannot reach a unit because of locked gates, parked vehicles, mud, snow, or similar, the visit may be billed as a trip charge of $______.
  5. Care of the units. The Customer will not move, tip, or relocate units without the Company's agreement, and will not put anything in a unit but human waste and toilet paper. Hazardous materials, paint, oil, concrete washout, and trash are prohibited. Cleanup of prohibited material is billed at cost plus ______%.
  6. Damage and loss. The Customer is responsible for damage beyond normal wear, and for loss, theft, fire, vandalism, graffiti, and tipping while units are on site, up to the replacement value of $______ per unit unless the damage was caused by the Company.
  7. Ownership. The units remain the property of the Company. The Customer may not sublet or lend them.
  8. Liability. Each party is responsible for its own negligence. The Customer will notify the Company promptly of any damage, misuse, or injury involving a unit.
  9. Permits. The Customer is responsible for any permit needed to place units on a street, sidewalk, or public property, unless the Company agrees in writing to obtain it.
  10. Entire agreement. This agreement and any attached quote are the whole agreement between the parties. Changes must be in writing and signed by both. This agreement is governed by the laws of the State of ______.

Three things that make it hold up.

  1. Fill in the blanks for your own rates, notice period, trip charge and replacement value before you send it. A blank left in a signed agreement is a term nobody agreed to.
  2. Attach the quote so the unit counts and prices the customer signs are the ones you'll bill.
  3. Keep the signed copy with the customer's record. When a unit comes back tipped or tagged with graffiti, the damage clause is the conversation.
